I. General terms and conditions of the agency

The subject matter of these general terms and conditions (GTCs) is, on the one hand, the agency's brokerage services and the general terms and conditions of the respective service providers, hereinafter referred to as escorts. MyDivine Escort

1. Contract with the agency

The agency acts exclusively as an intermediary. She places escorts with customers and receives a commission from the escorts for her work. The escorts are self-employed entrepreneurs who offer their services in their own name and for their own account. Payments for the services provided by the escorts are made exclusively to them, not to the agency. All details of the escorts' services are coordinated between them and their clients.

2. Booking attempts by minors

Minors may not use the agency's services. The agency reserves the right to ask customers to provide a copy of their identity document to verify their legal age. If they do not comply with the request or if, after verification, they are found to be minors, no mediation will take place.

3. Obligations of the agency/liability

The agency will make every effort to conclude a contract between the customer and the desired escort lady, but does not guarantee the conclusion of a contract with the escort lady. As independent entrepreneurs, the escort ladies can accept or reject inquiries at their discretion. The agency still does not guarantee the accuracy of the information provided by the escort ladies in their sedcards.
The agency points out that escort ladies, as independent entrepreneurs, are not vicarious agents of the agency. The agency is not responsible for the actions of the escorts. In addition, liability on the part of the agency for the nature, or quality of the service provided is excluded.

4. Payment, money receipt power of attorney

The client is not charged a separate fee for the placement of escorts by the agency. The respective services are billed directly between the customer and the escorts. Insofar as the agency is exceptionally entitled to receive the fee (for example in the case of advance payments), it has received a mandate from the escorts to receive money.

5. Data protection

The agency processes personal customer data in accordance with the relevant data protection regulations, in particular the Federal Data Protection Act and the General Data Protection Regulation, exclusively for processing bookings. Detailed information on data processing can be found in the agency's privacy policy.

II. General terms and conditions of escorts

1. Type and scope of services provided by escorts

The nature and scope of the contractual services are determined by the escorts and their customers on their own responsibility.

2. Escorts fee

Detailed information on fees and any travel expenses incurred is listed in the profiles of the individual escorts. Since the escorts determine their fee themselves, there may be differences in pricing. Customers can hand over the agreed fee to the escorts in an unsealed envelope at the beginning of the date. You can also transfer the fee to the agency in advance. In this case, the agency takes the fee in trust and forwards it to the respective escort lady. The agency has been provided with a money receipt power of attorney by the escorts.
The escorts may require a down payment of the agreed fee, for example for bookings with a longer total duration or a longer journey.
All costs incurred during the date (e.g. for food, drinks, tickets for events, etc.) are borne by the customer.
It is possible to extend the date. The fee for the extension must be handed over to the escort lady at the start of the extension.

3. Cancellation

Customers can cancel dates that have already been agreed for more than 2 days free of charge up to 24 hours before their start. Customers can cancel dates that have already been arranged for a shorter period of time free of charge up to 4 hours before their start.
For short-term cancellations by customers (less than 24 hours for dates lasting more than 2 days/less than 4 hours for shorter dates), customers are required to refund 30% of the total fee agreed for the date.
Should customers not make the date without prior notice, the full amount to be paid for the date must be paid to the escorts. Any deposits already made will not be refunded.
Escorts can cancel the date in the event of lasting disruptions or breach of contract by customers. In the event of an interruption due to the above reasons, neither the fee nor the travel expenses incurred will be refunded.
Customers and escorts can cancel the date after getting to know each other for the first time. In this case, the agency expects prompt notification of the termination of the date. Customers then only have to pay the travel expenses and a lump sum of EUR 100.00.

4. No direct contact

Most of the escorts have a serious main job. For this reason, discretion is very important to them. The escorts do not want private contacts with customers or private contact attempts by customers. Please respect this request and do not ask the escorts for their personal information. Direct contact attempts with the escorts are to be avoided. It is always necessary to use the agency to arrange an appointment.

5. Condom requirement/Other obligations of customers

According to the relevant provision of the Prostitute Protection Act (ProstSchG), condoms must be used during sexual intercourse.
The escorts expect clients to be at their best during the date and behave like real gentlemen. Customers will continue to ensure that the escorts are neither endangered nor damaged in their physical integrity or property when carrying out the date. Customers are liable for all damage suffered by the escorts as a result of their fault in the execution of the order.
